RightFit™ In-Home Flooring Experience
Overview
These Terms & Conditions apply to the RightFit™ In-Home Flooring Experience provided by Floors By Nature (WA) Pty Ltd ABN 78 676 542 993, trading as Floors By Nature ("we", "us", or "our"). Throughout this document, "Floors By Nature (WA) Pty Ltd" and "Floors By Nature" refer to the same legal entity.
By booking a consultation, you confirm that you are 18 years of age or older and have the authority to enter into this agreement in respect of the property to be visited.
Consultation Investment & Credit
The RightFit™ In-Home Flooring Experience may be offered as a paid consultation. Where a consultation investment applies:
- The consultation investment is payable prior to or at the time of booking
- If the client proceeds with their flooring project through Floors By Nature, the consultation investment will be credited in full toward the total project investment
- The credit applies only to projects proceeding with Floors By Nature and is not redeemable for cash
- The consultation investment credit is valid for 12 months from the date the ClearPlan™ Flooring Package is delivered. After 12 months, application of the credit is at the discretion of Floors By Nature. Credit validity will be stated on your ClearPlan™ document
- The consultation investment is non-refundable if the project does not proceed
- Promotional offers (including complimentary consultations) are limited and subject to availability
Cancellations & Rescheduling
A minimum of 48 hours' notice is required to cancel or reschedule your consultation. Late cancellations (within 48 hours) may result in forfeiture of the consultation investment.
If Floors By Nature needs to cancel or reschedule your appointment, we will provide as much notice as possible and offer a full refund of the consultation investment or the option to rebook at no additional cost.
Missed Appointments
If the client is not present at the scheduled time and no prior notice has been given, the consultation will be considered a missed appointment. The consultation investment may be forfeited and a rebooking investment may apply.
Client Responsibilities & Access
To enable a full and accurate consultation, the client agrees to:
- Ensure reasonable access to all rooms and areas relevant to the flooring project at the scheduled time
- Disclose any known subfloor issues, structural concerns, or relevant building work prior to or during the consultation
- Ensure a decision-maker for the property is present or available during the consultation
Where access is restricted or key areas cannot be visited, Floors By Nature cannot be held responsible for any limitations in the resulting ClearPlan™ Flooring Package.
Service Description
The RightFit™ Experience includes an in-home consultation, curated flooring recommendations, subfloor condition review, preparation advice, and a ClearPlan™ Flooring Package (a written project document).
The consultation is advisory in nature and does not constitute a structural engineering report, building inspection, pest inspection, or any other formal statutory assessment. Advice is provided on the basis of visual observation and professional flooring expertise only.
Photography, Video & Voice Recording
During the consultation, your specialist may capture photographs, video recordings, and voice recordings, and these materials may be processed using AI-assisted tools. The collection, use, storage, and disclosure of this information is governed by our Privacy Policy, which forms part of these Terms & Conditions.
For full details on how your information is collected, used, stored, and protected, please refer to our Privacy Policy at floorsbynature.com.au/privacy-policy.
ClearPlan™ Flooring Package
The ClearPlan™ Flooring Package is a written project document prepared by Floors By Nature following your in-home consultation. It includes product specifications, preparation requirements, installation methodology, project timeline, and total investment.
Upon delivery, the client retains the right to use the document for the purposes of their flooring project. The intellectual property, methodology, and format of the ClearPlan™ Flooring Package remain the property of Floors By Nature (WA) Pty Ltd.
The investment outlined in your ClearPlan™ is based on conditions observed at the time of the consultation and is valid for 30 days from the date of delivery. After this period, the investment may be subject to review.
Site Conditions & Variations
The investment outlined in your ClearPlan™ is based on information gathered during your RightFit™ consultation. Variations may arise once floor coverings have been removed or works have commenced, where site conditions such as subfloor condition, moisture levels, or structural factors differ from what was reasonably detectable at the time of the consultation.
Where a potential issue is identified during the consultation but its full extent cannot be determined until floor coverings are removed or works have commenced, this will be clearly noted in your ClearPlan™ as an unknown variable. Floors By Nature will communicate the nature of the potential issue upfront, and confirm the full scope and any associated investment variation once it can be properly assessed on site.
Where unforeseen subfloor or site conditions become evident only after works have commenced, including conditions that were not visible or reasonably detectable during the consultation, Floors By Nature will stop works, notify the client promptly, and obtain written approval before any further work proceeds. No additional investment will be incurred without your prior written agreement.
Installation Services
Installation may be carried out by Floors By Nature or by qualified third-party contractors engaged on your behalf. All contractors used by Floors By Nature are selected for their relevant trade experience and adherence to our quality standards.
Limitation of Liability
Advice provided during the RightFit™ consultation is based on professional experience and visual observation. Final outcomes depend on site conditions and external factors that may not be known at the time of the consultation.
To the maximum extent permitted by law, Floors By Nature's liability is limited to the re-supply of the consultation service or a refund of the consultation investment paid. Nothing in these Terms & Conditions excludes or limits any rights you may have under the Australian Consumer Law.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution directly by contacting Floors By Nature in writing at consult@floorsbynature.com.au. We will respond within 5 business days and make reasonable efforts to resolve the matter promptly.
If the dispute cannot be resolved directly, either party may refer the matter to a relevant dispute resolution body or seek legal remedies available under the laws of Western Australia.
Force Majeure
Floors By Nature will not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to severe weather, illness, natural disaster, or other events of force majeure. In such circumstances, we will contact you as soon as practicable to reschedule.
Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot be excluded by agreement.
Governing Law
These terms are governed by the laws of Western Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
